Question 1

Do I need to submit a claim for workers' compensation for an accident/injury?

Answer

No. You may wish to lodge an Accident/Injury Report form at the school detailing the accident/injury which did not result in medical attention. Once a report has been made, if your injury then requires medical attention you can then lodge a claim for workers' compensation. Bear in mind that you only have twelve months from the date of reporting your accident/injury to submit a claim for workers' compensation. Injuries that might require a report only would be minor cut fingers or minor abrasions. Back to top

Which forms do I need to submit a claim for workers' compensation?

Answer

The injured worker is required to submit an Employee's Report Form 2B and a Workers' Compensation First Medical Certificate from your initial treating doctor. The school is required to date stamp the forms when they are returned to line manager for processing. Back to top

Question 4

What timeframes are involved in lodging a claim for compensation?

Answer

The claim forms should be issued to the injured employee as soon as practicable after the accident/injury. This may mean posting to their home address. However, under the Workers' Compensation and Injury Management Act 1981, the injured employee has 12 months in which to lodge a claim for compensation.

The injured worker should return the forms to the principal or line manager as soon as practicable after completion.

Once in receipt of the Form 2B and First Medical Certificate (refer to checklist) the principal/line manager has three days to forward the forms to the Employee Support Bureau, Education and Training Shared Services Centre, GPO Box 2622, PERTH, WA 6001.

RiskCover have 17 days from the date the 2B and First Medical Certificate are received by the line manager, inclusive of weekends, in which to determine liability on the claim. They will advise the injured worker of the determination. Back to top

What leave do I load onto HRMIS?

Answer

If an injured employee is not at work any leave relating to workers' compensation is to be loaded as sick leave with a comment in the leave panel "sick leave pending acceptance of workers' compensation claim". Back to top

What relief codes do I use on HRMIS for employees on workers' compensation?

Answer

The relief employee's staffing advice should be processed using the following codes:

1471 - teaching staff;
1472 - non-teaching staff.

The above codes are only to be used for staff relieving for employees with accepted workers' compensation claims. The Employee Support Bureau must be contacted to determine whether a claim is approved or to seek approval to employ a relief person in special circumstances. Back to top

Why is my salary capped?

Answer

In October 1999, the State Government, made changes to the Workers' Compensation and Injury Management Act 1981. The changes precluded an injured employee from earning above a capped rate of wages whilst in receipt of compensation wage payments. This rate is indexed annually. For the period 1 July 2007 to 30 June 2008 it is $1722.60 per week. Back to top
